Article 1 – Definitions

In these conditions the following definitions apply:

  • Additional agreement : An agreement whereby the consumer acquires products, digital content and/or services in connection with a distance contract and these goods, digital content and/or services are supplied by the entrepreneur or by a third party on the basis of an agreement between the third party and the entrepreneur.
  • Consumer : The natural person who does not act for purposes related to his trade, business, craft or profession.
  • Right of withdrawal : The consumer's option to cancel the distance contract within the cooling-off period.
  • Entrepreneur : The natural or legal person who offers products, (access to) digital content and/or services remotely to consumers.
  • Distance contract : An agreement concluded between the entrepreneur and the consumer in the context of an organized system for distance selling of products, digital content and/or services, whereby exclusive or joint use is made until the conclusion of the agreement. made of one or more techniques for remote communication.

Article 3 – Applicability

  1. These general terms and conditions apply to every offer from Budsy.nl and to every distance contract concluded between Budsy.nl and the consumer.
  2. Before the distance contract is concluded, the text of these general terms and conditions will be made available to the consumer. If this is not reasonably possible, Budsy.nl will indicate how the general terms and conditions can be viewed and that they will be sent free of charge upon request.
  3. If the distance contract is concluded electronically, the text of these general terms and conditions can be made available to the consumer electronically, so that it can easily be stored on a durable data carrier.

Article 4 – The offer

  1. If an offer has a limited period of validity or is made subject to conditions, this will be expressly stated in the offer.
  2. The offer contains a complete and accurate description of the products, digital content and/or services offered. Images are a true representation of the products offered. Obvious mistakes or errors in the offer do not bind Budsy.nl.
  3. Each offer contains sufficient information so that it is clear to the consumer what the rights and obligations are associated with accepting the offer.

Article 5 – The agreement

  1. The agreement is concluded at the moment of acceptance by the consumer of the offer and compliance with the conditions set.
  2. Budsy.nl reserves the right to refuse an order or impose additional conditions if there are justified reasons, such as payment problems or suspicions of abuse.

Article 6 – Exclusion of right of withdrawal

Budsy.nl can exclude the following products and services from the right of withdrawal, provided this is clearly stated:

  • Products manufactured according to consumer specifications.
  • Products that spoil quickly or have a limited shelf life.
  • Sealed products that are not suitable for return for health or hygienic reasons and for which the seal has been broken.

Article 7 – The price

  1. The prices of the products and/or services offered will not be increased during the validity period of the offer, except for changes in VAT rates or shipping costs.
  2. Prices do not include shipping costs, unless stated otherwise.

Article 8 – Compliance and additional warranty

  1. Budsy.nl guarantees that the products and/or services comply with the agreement, the specifications in the offer, and the legal requirements of reliability and usability.
  2. Any additional guarantees never limit the statutory rights of the consumer.

Article 9 – Delivery and execution

  1. Budsy.nl will process orders with the utmost care.
  2. Delivery takes place at the address specified by the consumer.
  3. Orders will be delivered within 30 days, unless otherwise agreed. In the event of a delay, the consumer will be informed in a timely manner.
  4. Standard shipping : All packages are shipped with a tracking code. The risk of loss or damage lies with the consumer from the moment of delivery.

Article 10 – Payment

  1. The consumer must pay the amounts due before the products are shipped.
  2. Inaccuracies in payment details provided must be reported immediately to Budsy.nl.

Article 11 – Complaints procedure

  1. Complaints about the performance of the agreement must be submitted within a reasonable period.
  2. Budsy.nl handles complaints within 14 days and informs the consumer if more time is needed.
  3. The consumer must give Budsy.nl at least 4 weeks to resolve the complaint.

Article 12 – Additional or deviating provisions

  1. Additional provisions may not be to the detriment of the consumer and must be recorded in writing.
  2. Orders can only be placed by persons aged 18 or older. If in doubt, Budsy.nl can contact the customer randomly.

Article 13 – Privacy

  1. Budsy.nl respects the privacy of customers and deletes payment details within 72 hours of delivery.
  2. Personal data will only be used for processing orders and contact via e-mail.
  3. Customers can request to have their account and data deleted.

Article 14 – Disclaimer

  1. Budsy.nl does not sell weed, hash or other products directly. The service consists of collecting and shipping products on behalf of the customer.
  2. Budsy.nl reserves the right to cancel orders if there is suspicion of abuse or wholesale. In that case, payments will be fully refunded.
